1. About These Terms
These Customer Terms and Conditions (“Terms”) apply when you access or use customer-facing websites, payment pages, vehicle-request features, or other customer tools provided by Parkenjoy LLC (“Parkenjoy,” “we,” or “us”) (the “Customer Platform”). By using the Customer Platform, you agree to these Terms to the extent permitted by applicable law. If you do not agree, do not use the Customer Platform; ask the parking or valet operator about available alternatives. These Terms do not govern the operator’s subscription to Parkenjoy software.
2. Parkenjoy Is a Technology Provider
Parkenjoy LLC (“Parkenjoy”) provides software and technology that independent valet parking operators, parking businesses, and participating venues use to manage parking-related operations, payments, customer communications, and vehicle requests.
Parkenjoy does not itself provide physical valet parking services, employ valet attendants, or take possession, custody, or control of customers’ vehicles.
The independent business responsible for providing the physical parking service (the “Operator”) is responsible for its personnel, vehicle handling, parking operations, security, insurance, and compliance with applicable laws.
Claims involving vehicle damage, theft, loss of personal belongings, lost keys, improper vehicle handling, or the conduct of parking personnel should be directed to the applicable Operator.
Parkenjoy’s provision of software, payment technology, or communications tools does not, by itself, make Parkenjoy the provider of the physical parking service or responsible for the Operator’s acts or omissions.
Nothing in these Terms excludes any responsibility or liability that applicable law imposes directly on Parkenjoy.
3. Parking Services and Operator Rules
Your parking or valet service is provided by the applicable Operator, not Parkenjoy. Posted parking rules, claim-check conditions, location-specific policies, and any lawful terms presented by the Operator may apply separately to the physical parking service. Contact the Operator about its service rules, operating hours, parking rates, vehicle-release procedures, lost tickets, and claims involving your vehicle. An Operator’s separate terms cannot waive rights that applicable law makes nonwaivable.
4. Using the Customer Platform
You agree to provide accurate information when using the Customer Platform, including vehicle and contact information when requested. You must not misuse another customer’s ticket, access another person’s information, interfere with the Platform, attempt unauthorized access, or use the Platform unlawfully. You are responsible for maintaining the confidentiality of any ticket link, access code, or other credential you receive. If you believe a ticket or link has been compromised, notify the Operator promptly.
5. Rates, Payments, Tips, and Taxes
5.1 Parking Rates and Charges
The independent valet parking operator or other business responsible for providing the parking service (the “Operator”) establishes the rates and charges applicable to its parking or valet services, including parking fees, overtime charges, special-event rates, and other applicable charges. Rates may vary by Operator, parking location, service type, duration, and applicable validations or discounts.
5.2 Parkenjoy Platform Fees
Parkenjoy charges Operators a platform fee under their separate commercial agreements with Parkenjoy. This platform fee is a business-to-business charge payable by the Operator and is not added as a separate Parkenjoy fee to the customer’s parking transaction. Any other fees charged to customers by the Operator must be disclosed in accordance with applicable law.
5.3 Payment Processing
Electronic payments may be processed through independent payment service providers, including Stripe. The applicable Operator generally acts as the merchant of record for parking transactions, subject to the payment arrangement established for the location. Parkenjoy provides payment-related technology, transaction reporting, and related administrative services. Its involvement in payment processing does not make Parkenjoy the provider of the physical parking service.
5.4 Tips
Customers may voluntarily provide gratuities to valet personnel through the platform. Where tipping is available, the customer selects the gratuity amount before authorizing payment. The applicable Operator is responsible for administering and distributing gratuities in accordance with applicable law. Parkenjoy does not determine how Operators distribute gratuities to their personnel.
5.5 Taxes
Applicable taxes may be assessed on parking services and other taxable charges, depending on the jurisdiction and nature of the transaction. Taxes collected from customers will be disclosed as required by applicable law. The Operator or other legally responsible party is responsible for determining, collecting, reporting, and remitting applicable taxes.
5.6 Payment Authorization and Accuracy
Before completing an electronic payment, customers should review the applicable charges and total amount. By authorizing payment, customers agree to pay the charges presented during checkout, subject to applicable law and their available dispute and refund rights. Customers who identify an incorrect charge should contact the applicable Operator or designated payment-support contact. Nothing in this section limits consumer protections or rights that cannot lawfully be waived.
6. Refunds, Payment Disputes, and Chargebacks
6.1 Refunds for Parking Services
The independent Operator providing the physical parking or valet service is responsible for establishing and administering its refund and cancellation policies, subject to applicable law. Customers seeking refunds related to parking rates, service quality, parking duration, validations, vehicle handling, or other aspects of the physical parking service must direct their requests to the applicable Operator. Parkenjoy does not independently evaluate, approve, or deny refunds for physical parking services.
6.2 Technical Payment Errors
Parkenjoy may assist customers and Operators with technical payment errors attributable to the Parkenjoy platform, including duplicate transactions, incorrect amounts caused by software malfunctions, or transactions recorded incorrectly. Customers seeking assistance with a suspected technical payment error may contact Parkenjoy at info@parkenjoy.com. Parkenjoy may investigate available transaction records and coordinate with the Operator and applicable payment processor to facilitate appropriate corrections.
6.3 Refund Processing
Authorized Operator personnel may initiate refunds through the Parkenjoy platform, subject to applicable payment processor requirements. The Operator or other legally responsible merchant generally remains responsible for funding refunds relating to its parking services, except where applicable law or a separate agreement establishes otherwise. Refund processing times may depend on the applicable payment processor and the customer’s financial institution.
6.4 Chargebacks and Payment Disputes
Customers may exercise applicable rights to dispute card transactions through their financial institution or payment provider. The Operator or other responsible merchant generally handles chargebacks, payment disputes, and associated financial obligations under its payment processing arrangements. Parkenjoy may provide relevant transaction records and technical assistance when a dispute involves the operation of its platform.
6.5 Preservation of Legal Rights
Nothing in these Terms limits any refund, reimbursement, payment dispute, or consumer protection right that cannot lawfully be waived. Nothing in this section relieves Parkenjoy of responsibility for its own conduct where liability is imposed by applicable law.
7. Vehicle Requests and Retrieval
7.1 Vehicle Retrieval Requests
The Parkenjoy platform may allow customers to request retrieval of their vehicles electronically. When a customer submits a vehicle retrieval request, Parkenjoy transmits or makes the request available to the applicable independent Operator. The Operator is responsible for receiving, managing, and fulfilling vehicle retrieval requests and for the physical handling and delivery of vehicles.
7.2 Estimated Retrieval Times
Any estimated vehicle retrieval or waiting time displayed through Parkenjoy is provided for informational purposes only. Actual retrieval times may vary depending on parking conditions, staffing, traffic, weather, operational demands, and other circumstances beyond Parkenjoy’s control. Parkenjoy does not guarantee that a vehicle will be ready or delivered within a particular timeframe.
7.3 Vehicle Identification and Authorized Release
The Operator is responsible for establishing and following appropriate procedures to identify vehicles, verify customer authorization, and release vehicles only to authorized individuals. Electronic tickets, QR codes, confirmation messages, or other information displayed through Parkenjoy may assist the Operator in identifying a parking transaction but do not replace the Operator’s responsibility to verify authorization before releasing a vehicle.
7.4 Payment Verification and Vehicle Release
The Operator determines and enforces the payment verification and vehicle-release procedures applicable to its parking locations. Parkenjoy may provide payment status information, transaction records, and related software tools to assist the Operator. The Operator is responsible for reviewing applicable payment information, resolving outstanding parking charges, and determining whether a vehicle may be released. Parkenjoy’s provision of payment information or vehicle-release functionality does not transfer responsibility for physical vehicle release to Parkenjoy.
7.5 Technology Interruptions
Electronic vehicle retrieval functionality may be affected by internet connectivity, mobile networks, device functionality, maintenance, or other technical interruptions. If electronic retrieval functionality is unavailable, customers should contact the applicable Operator directly for assistance. Operators are responsible for maintaining appropriate alternative procedures to manage vehicle requests, verify payment status where applicable, and safely release vehicles during technology interruptions.
7.6 Vehicle Custody and Responsibility
Parkenjoy does not take possession, custody, or control of vehicles and does not employ or supervise the Operator’s valet personnel. The Operator remains responsible for physical parking operations, vehicle handling, custody, security, and release. Nothing in this section excludes liability that applicable law imposes directly on Parkenjoy.
8. SMS Communications and Consent
8.1 Transactional SMS Messages
Parkenjoy provides technology that enables participating independent parking and valet operators (“Operators”) to send transactional text messages relating to parking services. These messages may include parking ticket confirmations, vehicle retrieval notifications, payment links, payment confirmations, and other operational communications associated with a customer’s parking transaction. Messages may identify both the applicable Operator and Parkenjoy as the technology provider.
8.2 Customer Consent
Before enrolling a customer to receive transactional SMS messages, the Operator is responsible for requesting and obtaining the customer’s affirmative consent. Consent may be obtained verbally at vehicle arrival, where permitted by applicable law, and recorded electronically through the Parkenjoy platform. The Operator may record information relating to the consent, including the customer’s telephone number, parking location, date and time, method of consent, and consent status. Customers are not required to agree to receive optional SMS notifications as a condition of receiving physical valet parking services.
8.3 Message Frequency and Charges
Message frequency varies depending on the customer’s parking activity and the notifications associated with the transaction. Message and data rates may apply according to the customer’s mobile service plan.
8.4 Opting Out
Customers may opt out of SMS communications by replying STOP to a message received from the Parkenjoy-managed sending number. Parkenjoy and its messaging providers will process opt-out requests in accordance with applicable law and technical requirements. Because the same sending number may be used for communications involving multiple Operators, opting out may affect transactional SMS messages associated with other participating parking locations. After an effective opt-out, customers may need to use alternative methods to receive parking information or request vehicle retrieval.
8.5 No Marketing Messages
Parkenjoy’s transactional SMS messaging functionality is not intended for unsolicited advertising or promotional campaigns. Operators are not authorized to use Parkenjoy’s transactional SMS system to send marketing messages to customers.
8.6 Operator Responsibilities
Operators are responsible for requesting consent, accurately recording customer consent preferences, and using the messaging functionality in accordance with applicable law and Parkenjoy’s requirements. Parkenjoy may implement technical controls, message templates, opt-out management, and other safeguards to support compliant transactional communications.
8.7 SMS Assistance
Customers may contact the applicable Operator regarding parking-related messages or contact Parkenjoy at info@parkenjoy.com for technical assistance. Nothing in these Terms limits rights or protections provided under applicable telecommunications or consumer protection laws.

9. Privacy and Personal Information
9.1 Privacy Policy
Parkenjoy collects, uses, processes, and shares personal information as described in its Privacy Policy, available at https://parkenjoy.com/privacy.html. The Privacy Policy explains the categories of information processed, the purposes for which information is used, the service providers involved, applicable retention practices, and available privacy rights.
9.2 Independent Operator Responsibilities
Independent valet parking operators use the Parkenjoy platform to manage parking transactions, vehicle information, customer communications, and related operational records. Operators are responsible for their own collection and use of customer information in connection with the physical parking services they provide, including compliance with applicable privacy laws. Parkenjoy processes certain customer information to provide its software and related services to Operators, as further described in the Privacy Policy.
9.3 Privacy Requests and Assistance
Customers seeking access to, correction of, or deletion of information associated with a particular parking transaction should generally contact the applicable Operator first. Customers may also contact Parkenjoy at info@parkenjoy.com regarding Parkenjoy’s own privacy practices, technical assistance, or privacy requests that Parkenjoy is legally required to address. Parkenjoy may coordinate with the applicable Operator to respond to requests, subject to applicable law and the parties’ respective responsibilities.
9.4 Applicable Privacy Rights
Nothing in these Terms limits privacy rights or protections available to customers under applicable law.
10. Platform Availability and Third-Party Services
10.1 Platform Availability
Parkenjoy endeavors to provide reliable access to its software platform and related services. However, the platform may occasionally be unavailable, interrupted, delayed, or affected by technical errors. Parkenjoy does not guarantee that its services will be uninterrupted, error-free, or available at all times.
10.2 Internet Connectivity and Devices
The availability and performance of Parkenjoy’s services may depend on internet connections, cellular networks, mobile devices, operating systems, and other equipment or services outside Parkenjoy’s control. Parkenjoy is not responsible for interruptions or failures caused solely by third-party networks, customer devices, or other external systems beyond its reasonable control, except where applicable law provides otherwise.
10.3 Third-Party Service Providers
Parkenjoy integrates with independent third-party service providers to support payment processing, messaging, hosting, communications, and other platform functionality. These providers may include payment processors such as Stripe, messaging providers such as Twilio, and other technology service providers. The availability and performance of certain Parkenjoy features may depend on the continued operation of these third-party services. Parkenjoy is not responsible for the independent acts or omissions of third-party providers to the extent permitted by applicable law.
10.4 Maintenance and Updates
Parkenjoy may perform scheduled or emergency maintenance, software updates, security improvements, and other modifications necessary to maintain or improve the platform. These activities may temporarily affect the availability or functionality of certain services. Parkenjoy will make commercially reasonable efforts to minimize unnecessary interruptions.
10.5 Parking Operations During Interruptions
Independent Operators remain responsible for managing their physical parking operations, including vehicle custody, customer assistance, payment verification, and safe vehicle release, during interruptions affecting the Parkenjoy platform. Customers experiencing difficulties with electronic parking tickets, payments, or vehicle retrieval requests should contact the applicable Operator for assistance.
10.6 Technical Issues and Legal Rights
Customers may report suspected technical problems involving Parkenjoy’s platform to info@parkenjoy.com. Nothing in this section excludes liability for Parkenjoy’s own conduct where such liability cannot lawfully be excluded or limited.
11. Intellectual Property and Permitted Use
11.1 Ownership of the Parkenjoy Platform
The Parkenjoy platform, including its software, applications, interfaces, designs, graphics, logos, trademarks, documentation, and proprietary technology, is owned by Parkenjoy LLC or its applicable licensors and is protected by intellectual property laws. Except for the limited rights expressly granted in these Terms, no ownership rights or intellectual property interests are transferred to customers through their use of the platform.
11.2 Limited Right to Use
Parkenjoy grants customers a limited, nonexclusive, nontransferable, revocable right to access and use its customer-facing platform for lawful, personal parking-related activities, subject to these Terms. This permission does not authorize commercial resale, redistribution, or exploitation of Parkenjoy’s software or technology.
11.3 Prohibited Activities
Customers may not copy, reproduce, modify, distribute, or commercially exploit Parkenjoy’s software or proprietary materials without authorization; reverse engineer, decompile, or attempt to discover platform source code except where restrictions are prohibited by law; attempt unauthorized access; interfere with platform security, operation, or availability; scrape or extract information using unauthorized automated tools; impersonate others, submit fraudulent information, or misuse parking tickets, QR codes, or payment functionality; or use the platform unlawfully or in violation of others’ rights.
11.4 Customer Information
These Terms do not transfer ownership of customers’ personal information to Parkenjoy. Personal information is handled in accordance with Parkenjoy’s Privacy Policy and applicable law.
11.5 Trademarks and Branding
The Parkenjoy name, logos, trademarks, and related branding may not be used without Parkenjoy’s prior written authorization, except as permitted by applicable law.
11.6 Suggestions and Feedback
Customers may voluntarily provide suggestions, comments, or feedback regarding Parkenjoy’s services. Parkenjoy may use such feedback to evaluate, develop, and improve its products and services without compensation to the person providing it, provided that such use complies with applicable law and does not override applicable privacy rights.
12. Disclaimers and Limitations of Liability
12.1 Technology Services Only
Parkenjoy provides software and related technology services that independent parking and valet operators use to manage parking transactions, payments, communications, and vehicle requests. Parkenjoy does not provide physical valet parking services, operate parking facilities, employ valet attendants, or take possession, custody, or control of customers’ vehicles. Each independent Operator is responsible for its own physical parking services, personnel, vehicle handling, security, and compliance with applicable laws.
12.2 Operator Conduct and Vehicle-Related Claims
To the extent permitted by applicable law, Parkenjoy is not responsible for losses, damages, injuries, or claims arising solely from an independent Operator’s physical parking activities or acts or omissions, including damage to or theft of vehicles; loss of vehicle keys or personal belongings; improper vehicle handling or unauthorized vehicle release; conduct or negligence of valet attendants or other Operator personnel; and parking delays, staffing issues, or operational decisions made by the Operator. Customers should direct claims relating to these matters to the applicable Operator. This provision does not exclude responsibility for Parkenjoy’s own conduct where liability is imposed by applicable law.
12.3 Platform Availability and Warranties
To the maximum extent permitted by applicable law, Parkenjoy’s customer-facing technology is provided on an “as available” basis. Parkenjoy does not warrant that the platform will operate without interruption, delay, or error, or that every feature will be available at all times. Nothing in these Terms excludes warranties or consumer protections that cannot lawfully be excluded.
12.4 Third-Party Services
Certain Parkenjoy functions depend on independent payment processors, telecommunications providers, hosting services, and other third-party systems. To the extent permitted by applicable law, Parkenjoy is not responsible for losses arising solely from the independent acts, omissions, or service failures of such third parties. This provision does not exclude liability attributable to Parkenjoy’s own conduct.
12.5 Exclusion of Certain Damages
To the maximum extent permitted by applicable law, Parkenjoy will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from the use of its customer-facing technology, including lost profits or business opportunities, where such exclusions are legally enforceable. This exclusion does not apply where prohibited by applicable law.
12.6 Limitation of Liability
To the maximum extent permitted by applicable law, Parkenjoy’s aggregate liability arising from or relating to a customer’s use of its customer-facing technology will not exceed the greater of: (a) the amount, if any, paid directly to Parkenjoy by that customer for the relevant technology service during the twelve (12) months preceding the event giving rise to the claim; or (b) one hundred U.S. dollars (US $100). This limitation does not apply to liability that cannot lawfully be limited, including liability arising from fraud, willful misconduct, or other conduct to the extent applicable law prohibits such limitation.
12.7 Preservation of Legal Rights
Nothing in these Terms excludes or limits any right, remedy, or liability that cannot lawfully be excluded or limited under applicable law. Nothing in these Terms prevents a customer from pursuing legally available claims against Parkenjoy for Parkenjoy’s own conduct.
13. Suspension and Termination of Access
13.1 Suspension or Restriction of Access
Parkenjoy may suspend, restrict, or terminate a customer’s access to its customer-facing technology when reasonably necessary to address suspected fraud, unauthorized transactions, or misuse of payment functionality; prevent unauthorized access to accounts, electronic parking tickets, QR codes, or other platform features; protect platform security, integrity, or availability; respond to violations of these Terms or applicable law; or comply with legal requirements or lawful requests from competent authorities. Parkenjoy may take immediate action when reasonably necessary to address security threats, suspected fraud, or other urgent risks. Where reasonably practicable and appropriate under the circumstances, Parkenjoy may provide notice of a suspension or restriction and an opportunity to resolve the underlying issue.
13.2 Discontinuation of Services
Certain Parkenjoy features may become unavailable if an independent Operator discontinues its use of Parkenjoy, closes a parking location, or terminates its commercial agreement with Parkenjoy. Parkenjoy may also modify, discontinue, or replace customer-facing features, subject to applicable law and any applicable contractual obligations.
13.3 Effect on Physical Parking Services
Suspension or termination of access to Parkenjoy’s technology does not, by itself, terminate a customer’s separate parking arrangement with the applicable Operator. The Operator remains responsible for physical parking services, vehicle custody, payment verification, and authorized vehicle release. Customers who cannot access their electronic parking ticket or vehicle retrieval functionality should contact the applicable Operator directly for assistance.
13.4 Outstanding Charges and Transactions
Suspension or termination of platform access does not automatically cancel parking charges or other payment obligations lawfully owed to the applicable Operator. The Operator remains responsible for determining and administering outstanding parking charges, refunds, and related matters.
13.5 Information and Records
Information associated with parking transactions may be retained or processed following suspension or termination of access as described in Parkenjoy’s Privacy Policy and as required or permitted by applicable law.
13.6 Preservation of Legal Rights
Nothing in this section authorizes Parkenjoy to interfere unlawfully with a customer’s right to recover their vehicle or limits rights and remedies that cannot lawfully be waived.
14. Governing Law and Dispute Resolution
14.1 Governing Law
These Terms and any dispute arising out of or relating to their interpretation, enforcement, or a customer’s use of Parkenjoy’s customer-facing technology shall be governed by the laws of the State of Florida, without regard to its conflict-of-law principles, except to the extent that applicable law requires otherwise.
14.2 Informal Resolution of Disputes
Customers who experience a problem involving Parkenjoy’s technology are encouraged to contact Parkenjoy at info@parkenjoy.com before initiating formal legal proceedings. Parkenjoy will make reasonable efforts to review and respond to concerns relating to its technology. Disputes involving physical parking services, vehicle damage, lost keys, parking rates, or the conduct of valet personnel should generally be directed to the applicable independent Operator. Nothing in this section requires customers to waive their legal rights or prevents them from pursuing legally available remedies.
14.3 Jurisdiction and Venue
To the extent permitted by applicable law, legal proceedings arising from or relating to these Terms or Parkenjoy’s customer-facing technology shall be brought in the state or federal courts located in Miami-Dade County, Florida. Each party consents to the jurisdiction of those courts for such proceedings, subject to applicable law and any mandatory consumer protections. This provision does not override jurisdiction or venue rights that cannot lawfully be waived.
14.4 No Mandatory Arbitration
These Terms do not require customers to resolve disputes through binding arbitration. Nothing prevents the parties from voluntarily agreeing to an alternative dispute resolution process after a dispute arises.
14.5 Preservation of Legal Rights
Nothing in this section limits any right, remedy, or protection that cannot lawfully be waived under applicable law.
15. Changes to Terms and Contact Information
15.1 Changes to These Terms
Parkenjoy may revise these Terms from time to time to reflect changes in its technology, services, business operations, legal requirements, or other legitimate business needs. The updated Terms will be made available through Parkenjoy’s website or other appropriate customer-facing channels.
15.2 Effective Date and Notice
Each version of these Terms will identify its effective date. Changes will generally apply prospectively from their stated effective date, unless applicable law requires otherwise. Where required by applicable law, Parkenjoy will provide appropriate notice of material changes and obtain any necessary consent. Parkenjoy may also provide additional notice through its website, applications, or other appropriate communications.
15.3 Continued Use
A customer’s continued use of Parkenjoy’s customer-facing technology after updated Terms become effective may constitute acceptance of those Terms to the extent permitted by applicable law and where appropriate notice has been provided. Where applicable law requires affirmative acceptance, Parkenjoy will obtain that acceptance before relying on the revised provisions.
15.4 Contact Information
Questions regarding these Terms, Parkenjoy’s technology, or technical payment issues may be directed to: Parkenjoy LLC; Email: info@parkenjoy.com; Telephone: +1 (786) 822-0838; Website: https://parkenjoy.com. For questions involving parking rates, physical valet services, vehicle damage, lost keys, refunds, or other matters relating to parking operations, customers should contact the applicable independent Operator.
15.5 Preservation of Legal Rights
Nothing in this section limits rights or protections that cannot lawfully be waived under applicable law.
